Article 1: Definitions

  1. In these general terms and conditions the following definitions apply:
    • Landlord: the owner of the holiday home (Diepstraten & Diepstraten GbR).
    • Tenant: the person who concludes the rental agreement and is responsible for all fellow guests.
    • Holiday home: the rented accommodation, at the address [address_1], [address_2] in [city], [country].
    • Rental Agreement: the confirmed reservation between the landlord and the tenant.

Article 2: Applicability

  1. These general terms and conditions apply to all reservations and rental agreements.
  2. By making a reservation, the tenant agrees to these conditions.

Article 3: Reservation and formation

  1. A reservation is final after the landlord has confirmed it in writing or by e-mail.
  2. The main tenant must be at least 18 years old.
  3. The main tenant is liable for all obligations arising from the rental agreement.

Article 4: Payment

  1. A deposit of 30% of the rental amount is due upon reservation, unless otherwise agreed.
  2. The remainder must be paid no later than 6 weeks before arrival.
  3. For reservations made within 6 weeks before arrival, the full amount must be paid immediately.
  4. If payment is not made on time, the landlord is entitled to cancel the reservation.

Article 5: Cancellation by the tenant

  1. In the event of cancellation, the following percentages of the rental price will be refunded to you:
    • Up to 60 days before arrival: [until_60_days]% of the rental amount
    • 59 to 30 days before arrival: [59-30_days]% of the rental sum
    • 29 to 14 days before arrival: [29-14_days]% of the rental sum
    • Less than 14 days before arrival or in case of no-show: [less_14_days]% of the rental price
  2. We recommend taking out cancellation insurance.

Article 6: Cancellation by the landlord

  1. If the landlord cannot fulfill the agreement due to unforeseen circumstances, the tenant will be informed of this as soon as possible.
  2. In such a situation, the landlord will offer another period or refund the rental sum already paid.
  3. Further compensation is excluded.

Article 7: Arrival and departure

  1. Check-in is possible from 16:00 hours.
  2. Check-out must take place no later than 10:00 hours.
  3. Deviations are only possible after prior permission from the landlord.

Article 8: Use of the holiday home

  1. The house may only be used by the agreed number of people.
  2. Parties, events and nuisance are not allowed.
  3. Smoking in the holiday home is not permitted.
  4. Pets are not allowed in the holiday home.
  5. The tenant must handle the property and inventory with care.

Article 9: Damage

  1. Damage or defects must be reported to the landlord immediately.
  2. Damage caused by the tenant or fellow guests will be borne by the tenant.
  3. Normal wear and tear is not covered by the tenant's liability.

Article 10: Liability

  1. Stay in and around the holiday home is at your own risk.
  2. The landlord is not liable for loss, theft or damage to personal property.

Article 11: Force majeure

  1. Force majeure includes natural disasters, war, pandemics, government measures, prolonged power outages and other circumstances beyond the landlord's control. In such cases, a reasonable solution will be sought in consultation.

Article 12: Complaints

  1. Complaints must be reported to the landlord as soon as possible during the stay.
  2. If a complaint is not reported on site, the right to compensation may lapse to the extent that the landlord has not had the opportunity to resolve the problem.

Article 13: Privacy

  1. Personal data will only be processed for the execution of the rental agreement and in accordance with the applicable privacy legislation (AVG/GDPR).

Article 14: Tourist tax

  1. The tourist tax is paid by the tenant in accordance with applicable local regulations.

Article 15: Applicable law and competent court

  1. German law applies to this agreement, unless mandatory consumer protection law provides otherwise.
  2. Disputes will be submitted to the competent court in Germany, unless mandatory legal provisions prescribe otherwise.
